Please read these terms & conditions carefully before ordering any products from us. You should understand that by ordering any of our products, you agree to be bound by these terms & conditions.

Ordering, postage and delivery

IN BRIEF Please allow 3 business days for processing and fulfilment of your order. Orders are posted Monday-Wednesday. Hand couriers are sent Monday-Friday.

We offer hand couriered delivery on a number of products to the Brisbane CBD and surrounding suburbs, as well as the major hospitals. As lovely a surprise chocolates are, please ensure there will be someone available to accept the delivery.  We reserve the right to charge a redelivery fee. A redelivery fee will be charged for any delivered orders returned to us due to incomplete or missing details. Our redelivery fee is $15 and must be paid before items are redelivered. Any orders that do not have their redelivery fee paid within 3 days of the request being made will be cancelled and will not be refunded. Please ensure all details are checked carefully.

Standard orders outside our Hand Delivery Zone are sent via Express Post with a foodsafe ice pack and insulated wrapping. 31 Degrees will take all precautions to ensure your order arrives in the best possible condition, but cannot be held responsible for the condition in which your order arrives. We cannot be held responsible if the recipient is not present when your order is delivered, please ensure you get your order shipped where it can be signed for during business hours.  Due to the climate of Brisbane, 31 Degrees reserves the right to withhold posting orders if the temperature is over 35 degrees Celsius. 

Please allow 3 business days for processing and fulfilment of your order. Every effort will be made to ensure delivery on the specified date, but cannot be guaranteed. As our products are made fresh, please specify the date you would like your chocolate, or if you would like it whenever it is ready, please write ASAP in the relevant section at checkout. Orders placed on a Tuesday or Wednesday may not be posted until the following Monday.

Orders outside the Express Post Next Day Delivery Zone will not be posted after Wednesday. Orders will not be posted on a Friday. This is to ensure your order does not sit in the postal depot over the weekend. 

31 Degrees reserves the right to refuse any order, and refund any monies paid. 

All products are made in the same kitchen, and so there may be traces of nuts, gluten, diary, wheat and soy. Please use discretion when consuming products if you have an allergy.

Each order is made fresh. All items are handmade, and may vary slightly in look, decoration, size or texture, but will always be of high quality. Photographs on this site are for illustrative purposes only. 

Any custom chocolate recipes will be owned by 31 Degrees, and may become part of the standard chocolate list.

Payments

Payments are processed using Stripe or PayPal, a dedicated third party gateway, to guarantee your protection. Card information is not stored and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made.

Deposits made for wedding or large orders are non refundable.

All products remain the property of 31 Degrees until full payment is made.

Privacy Policy

We collect information from you when you place an order or fill out a form. When ordering or registering on our site, as appropriate, you may be asked to supply your name, email address, contact number and delivery address. Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested. The email address you provide for order processing will only be used to send you information and updates pertaining to your order. You have the right to inspect information held about you. You have the right to request that any information held on you can be corrected or deleted.

Cookies

31 Degrees uses cookies according to the new Electronic Communications Act, which came into force on 25 July 2003. A cookie is a small text file stored on your computer that contains information that helps the website to identify and track the visitor. Cookies do no harm to your computer, consist only of text, can not contain viruses and occupies virtually no space on your hard drive. There are two types of cookies: "Session Cookies" and cookies that are saved permanently on your computer.

The first type of cookie commonly used is "Session Cookies". During the time you visit the website, our web server assigns your browser a unique identifier string so as not to confuse you with other visitors. A "Session Cookie" is never stored permanently on your computer and disappears when you close your browser. To use 31 Degrees without troubles you need to have cookies enabled.

The second type of cookie saves a file permanently on your computer. This type of cookie is used to track how visitors move around on the website. This is only used to offer visitors better services and support. The text files can be deleted. On 31 Degrees we use this type of cookie to keep track of your shopping cart and to keep statistics of our visitors. The information stored on your computer is only a unique number, without any connection to personal information.

Return Policy

The Australian Consumer Law provides basic rights for consumers to return goods that they have bought, including if they are faulty, don’t match samples, or don't perform as expected.

It will be at the discretion of 31 Degrees, with consultation with the buyer, if an item will be replaced or refunded. Applications for replacement or refund must be within 3 days of purchase, or within 2 days of the receipt of a delivery.

If products are to be replaced, the original purchased items must be returned at least 80% unused and in the original packaging.

We are not required to offer an exchange or refund for change of mind.

31 Degrees will not replace items that have not be correctly stored. Please read the FAQ for storage instructions
